Terms
Rental Agreement
THIS TRAILER RENTAL AGREEMENT (the “Agreement”), dated on the last date written below the signature lines on the final page of this document, is between Forest City Rentals LLC (the “Company”) and the party whose name appears on the final page of this document, below (the “Renter”) (collectively, the “Parties”). IN CONSIDERATION OF the mutual covenants in this. Agreement, the receipt and sufficiency of which is hereby acknowledged, the Parties agree to the following terms:
1. Rental
Pursuant to the terms and conditions set forth herein, Company shall provide the following trailers:
2026 Lamar 10k 8.5'x22' Car Hauler (collectively, the "Trailer" or individually, the "Trailer").
2. Use
Renter may use the Trailer for moving, transporting, or relocating purposes only. The transportation or storage of any goods or things which may be deemed to be illegal under any federal or state law is strictly prohibited. Only Renter may drive the vehicle towing the Trailer. Renter will use the Trailer in a careful manner, in the manner for which it was designed to be used, and not in any other manner. Renter will comply with applicable law and all the manufacturer’s requirements and recommendations respecting the Trailer. Except as agreed to in a writing signed by both Parties, Renter agrees not to alter, modify or attach anything to the Trailer.
3. Duration, Delivery
The Rental Period is defined as the Start Date and Time and the Return Date and Time communicated and confirmed through any booking method, including but not limited to online reservations, text messages, phone calls, emails, or social media messaging. All such booking communications constitute part of this Agreement and are binding. Renter shall, at his/her own expense and risk, pick up the trailer and must return the Trailer to Company's trailer lot located in Rockford, Illinois, or other location specified by Company on the date and time specified in this Agreement and in the same condition Renter received the Trailer, except for ordinary wear. If the Trailer is returned after closing hours, Renter shall remain responsible for the safety of and any damage to the Trailer until Company inspects it upon Company's next opening for business. If Renter fails to return the Trailer by the Return Date or any earlier termination of this Agreement, Renter will pay to Company any unpaid Rent for the Term plus 110% of the fair market value of the Trailer, at which point ownership of the Trailer will pass to Renter.
4. Driver's License
Renter must be at least 25 years old and shall present, at the time of rental, a driver's license issued by any state, territory or possession of the United States that is valid for the entire rental period. Company shall make a copy of such license for its file. Renter acknowledges that operating the Trailer may require a Commercial Driver’s License (CDL) or special endorsements depending on the Gross Vehicle Weight Rating (GVWR) of the towing vehicle and the combined weight of the vehicle and trailer. It is the sole responsibility of the renter to ensure compliance with all applicable local, state, and federal licensing laws. By signing this agreement, the renter affirms that they possess the necessary and valid driver’s license and endorsements required to legally tow the trailer. The Company is not responsible for any citations, fines, or legal actions resulting from the renter’s failure to meet these requirements.
5. Fees
Total rental charges shall include the price selected at booking and any additional fees incurred for extra rental days beyond the reserved return date. The Rent will be paid prior to Renter taking possession of the Trailer, along with a CARD ON FILE.
(a) In addition to the Rent, Renter agrees to pay all charges due to Company under this Agreement on demand from Company, including: (i) Loss of or damage to the Trailer, which includes the cost to repair the Trailer to its condition on the Commencement Date, or 110% of the actual cash value of the Trailer based on valuation methods accepted by the auto insurance industry on the date of the loss if the Trailer is not repairable, or if Company elects not to repair the Trailer; (ii) Cleaning cost if the Trailer is not returned in the same condition rented; (iii) Actual expenses incurred by Company in locating and recovering the Trailer if Renter fails to return it or Company elects to repossess the Trailer under the terms of this Agreement; and (iv) Loss or damage to the items on the “Items Included” list, attached and incorporated into this Agreement, at the cost for each item stated in that list.
(b) Renter must present at the time of rental a payment card (credit, debit or prepaid debit card) in Renter's name, which will be charged by Company upon the occurrence of any of the events set forth in Section 5(a). Eligible payment cards are American Express, Discover, MasterCard or Visa.
(c) Renter agrees that he/she has been provided with a Trailer Inspection Report (the “Report”) prior to the Commencement Date, that he/she has had the opportunity to fully inspect the Trailer and the Trailer’s connection to Renter’s vehicle, that the connection to Renter’s vehicle is secure, and that the Report returned to the Company reflects any and all issues and/or damage to the Trailer prior to the Commencement Date. If Renter fails to return the completed Report to Company prior to the Commencement date, Renter assumes responsibility for any and all issues and damage to the Trailer, as observed by Company after the Commencement Date.
6. Liability Insurance
At the time of rental, Renter shall provide Company proof of vehicle liability, collision and comprehensive insurance covering Renter, Company, and the Trailer. Renter is responsible for all damage or loss caused to others.
7. Repossession and Warranties
This Agreement is a contract for the rental of the Trailer. Company may repossess the Trailer at Renter's expense without notice to Renter, if the Vehicle is abandoned or used in violation of law or this Agreement. Renter agrees to indemnify Company, defend Company and hold Company harmless from all claims, liability, cost and attorney fees incurred by Company resulting from, or arising out of, this rental and/or Renter's use of the Trailer. COMPANY MAKES NO WARRANTIES, EXPRESS, IMPLIED OR APPARENT REGARDING THE TRAILER, NO WARRANTY OF MERCHANTABILITY, AND NO WARRANTY THAT THE TRAILER IS FIT FOR A PARTICULAR PURPOSE. RENTER ASSUMES ALL LIABILITY FOR DAMAGE OR INJURY CAUSED BY ANY FAULTY CONNECTION BETWEEN THE TRAILER AND RENTER’S VEHICLE.
8. Responsibility for Damage or Loss; Reporting
Renter is responsible for all damage to the Trailer, missing equipment, and Company's administrative expenses connected with any damage claim, regardless of whether Renter is at fault. Renter is responsible for loss due to theft of the Trailer and all damages due to vandalism that occurs in connection with a theft, if Renter fails to exercise ordinary care while in possession of the Trailer. Renter is responsible for damage due to vandalism not associated with theft of the Trailer up to a maximum of $500. Renter must report all accidents or incidents of theft or vandalism to the police as soon as Renter discovers them. Renter must report all damage, theft, vandalism, accidents, etc. involving the Trailer to Company as soon as is reasonably possible, but in no case shall Renter report such to the Company after more than 24 hours have passed since the incident’s occurrence. Under no circumstances shall rent paid to Company be reimbursed to Renter for any incident mentioned in this paragraph which may affect Renter’s use of the Trailer during the Rental Term. Company may subtract damage or loss amounts from any deposit collected.
9. Personal Property
Renter releases Company from all claims for loss of, or damages to, Renter's personal property or that of any other person, that was left or carried in the Trailer.
10. Condition of Trailer
Company shall provide the Trailer in clean and operating condition. Service to the Trailer or replacement of parts during the rental must have Company's prior approval. Renter must check and maintain tire air pressure during the rental period.
11. Driving Restrictions & Road Hazards/Debris
The Trailer shall not be driven outside the Continental United States. The Trailer shall only be driven on paved roads. Renter shall provide his/her own brake controller. The Company shall be responsible for tire replacement or repair arising from normal wear and tear, including tread loss or aging. The Renter shall be responsible for all damages resulting from road debris, hazards, or impacts, including but not limited to tire blowouts or damage to tires that were in good condition at the time of rental. The Renter shall also be responsible for tire damage caused by improper use or handling, including but not limited to failure to properly set trailer brakes, improper load distribution, or overloading that results in flat spots, uneven wear, or other major tire damage.
12. Waiver and Indemnification
Renter, individually and on behalf of himself/herself, his/her personal representatives, heirs, successors and assigns, agree to hold harmless, defend, and indemnify Company from any and all claims, suits, or causes of action by others for bodily injury, property damage, or other damages, including attorneys’ fees and costs, which may arise out of, result from, occur during, or are in any way connected with Renter's rental and use of the Trailer and any equipment related thereto, including claims arising from Company's or any other party's negligence.
RENTER AGREES THIS AGREEMENT IS TO BE CONSTRUED BROADLY TO PROVIDE A WAIVER, RELEASE AND INDEMNIFICATION TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAW.
13. Default
Renter shall be in default of this Agreement if any of the following events (each an “Event of Default”) occur: a) Renter fails to pay any amount provided for in this Agreement when such amount is due or otherwise breaches Renter’s obligations under this Agreement; b) Renter becomes insolvent or makes an assignment of rights or property for the benefit of creditors or files for or has bankruptcy proceedings instituted against it; or c) a writ of attachment or execution is levied on the Trailer and is not released or satisfied within 10 days.
14. Remedies
On the occurrence of an Event of Default, Company is entitled to pursue any one or more of the following remedies: a) declare the entire amount of Rent for the Term immediately due and payable without notice or demand to Renter; b) commence legal proceedings to recover the Rent and other obligations accrued before and after the Event of Default; c) take possession of the Trailer, without demand or notice, wherever the same may be located, without any court order or other process of law, with Renter waiving any and all claims for damage occasioned by such taking of possession; d) terminate this Agreement immediately upon written notice to Renter; e) pursue any other remedy available in law or equity.
15. Entire Agreement
This Agreement constitutes the entire agreement between the Parties. Any prior understanding or representation of any kind, if not written in this Agreement, will not be binding on either Party. Any amendment or modification of this Agreement must be in writing, signed by both Parties.
16. Governing Law, Venue and Attorneys’ Fees
This Agreement is governed by the laws of the State of Illinois. Any suit or action brought to enforce this Agreement must be brought in Winnebago County, Illinois. In the event of any arbitration or litigation, the prevailing party shall be entitled to its reasonable attorneys’ fees and all related costs and expenses.
17. Severability
If any term of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining terms will, nevertheless, continue in effect without being impaired or invalidated in any way.
18. Weight Restrictions:
The 2026 Lamar 10k 8.5'x22' Car Hauler has a maximum legal load capacity of 7,000 pounds. It is the responsibility of the Renter to ensure that this limit is not exceeded. Overloading the trailer may result in additional fines, towing issues, mechanical damage, and/or legal liability. If the trailer is returned overloaded or if overloading results in damage or mechanical failure, the Renter will be fully responsible for all repair costs, towing fees, downtime loss, and any legal penalties incurred.
19. LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES SHALL COMPANY OR COMPANY'S REPRESENTATIVES, EMPLOYEES, AGENTS OR CONTRACTORS BE LIABLE FOR DAMAGE OR INJURY TO RENTER, RENTER’S PROPERTY OR RENTER’S BUSINESS, OR FOR ANY LOSS OF INCOME OR PROFIT THEREFROM. IN WITNESS WHEREOF, the parties have executed this Agreement on the day and year first above written.
1. Trailer Safety Statement
I acknowledge that I have been offered instruction on the proper use, handling, and safety procedures for all rental equipment and trailers provided by Forest City Rentals, in accordance with the manufacturers’ recommendations. I have either received instruction in person or by video from a representative of Forest City Rentals, or declined instruction, stating that I am already familiar with the proper and safe operation of the trailer and related equipment. In either case, I have been given the opportunity to ask questions, and I accept full responsibility for the safe, legal, and proper use of the equipment during the rental period. I understand that misuse or negligent operation may result in personal injury, property damage, or additional charges, and I agree to hold Forest City Rentals LLC harmless from any resulting claims or liabilities. 2. Use & Trailer Limitations
I certify that I have informed Forest City Rentals LLC of my intent to use the trailer and what I will be hauling with it. In the event I decide to move something else with the Trailer, I will update Forest City Rentals by email, call, or text message to ensure the load being hauled complies with the Trailer’s specifications and limits. I understand that the Trailer I am renting has weight and size limits that I am responsible for adhering to while renting. This includes factors such as weight capacity, size dimensions, and load distribution. Exceeding these limits can lead to safety hazards, such as loss of control or Trailer damage, and will also violate Forest City Rentals LLC TRAILER RENTAL AGREEMENT. In the event that I load anything exceeding the limitations of the Trailer or any included accessories, I am responsible for any and all liability and/or damage that occurs as a result. I agree that the Trailer and all of the accessories I am renting are in good working condition and I am responsible for returning these items in the same condition after my rental. I agree to hold Forest City Rentals LLC harmless if my renting of this Trailer and the accessories causes any damages to myself or my property and I take full responsibility for any damages that may be caused to other people and/or their property.

I acknowledge receiving all items above and know that I am responsible for returning all items in good working condition or else I will be expected to pay for that item.
4. Inspection
The Renter acknowledges that this Agreement must be signed prior to pickup in order for any Trailer to be reserved or released. Upon arrival, the Renter will have the opportunity to inspect the Trailer, tires, hitch, and all included items and accessories. If, for any reason, the Renter finds the Trailer unsatisfactory, they may notify the Company immediately and choose not to proceed with the rental. In such case, the reservation will be canceled without penalty and any payments made will be fully refunded.
5. Responsibility
I understand that I am responsible for any and all damages up to and including theft.
6. Cancellation Policy – Forest City Rentals LLC
We understand that plans can change, and we strive to be fair while protecting our schedule and equipment availability. 48 hours or more before your scheduled rental: Full refund. 24 to 48 hours before your scheduled rental: A 25% cancellation fee will apply (75% refund). Less than 24 hours before your scheduled rental (before the rental date): A 50% cancellation fee will apply (50% refund). Same-day cancellations or no-shows: Non-refundable.
If you need to reschedule, we're happy to work with you. Reschedule requests made at least 24 hours before your scheduled rental will be accommodated at no additional charge, subject to availability.
In the event of severe weather or other unforeseen circumstances, we may make exceptions at our sole discretion. By booking with Forest City Rentals LLC, you acknowledge and agree to this cancellation policy.
7. SMS Terms & Consent
By checking the text message consent box during checkout, you agree to receive text messages from Forest City Rentals LLC regarding your trailer rental, including booking confirmations, pickup instructions, rental reminders, rental updates, extension notifications, return reminders, and overdue notifications. Message frequency varies. Message & data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase.
8. Final Signature
By signing below, I acknowledge that I have been given the opportunity to read the Terms and Conditions of this Agreement as well as the Trailer Rental Agreement form before being asked to sign. My signature authorizes Forest City Rentals LLC to process my credit card for all changes due under this agreement. Including charges as listed above and later payment of any traffic, toll or parking violations assessed against the Trailer while in my possession.
